At the beginning of Wano, Luffy was too confident and decided to attack Kaido head-on. In one fell swoop, Kaido defeated Luffy. At that moment, Kaido could have easily killed Luffy, but instead chose to send him to prison to break his spirit.
Kaido technically killed Luffy later in this arc as well. During their confrontation in Onigashima, Kaido kills Luffy on the roof after an intervention from CP0. However, Luffy's heart started beating again thanks to his Awakened Gear 5. Under any other circumstances, Luffy would have lost and died here. It is only after the awakening that Luffy is finally able to defeat him.
